1. Overview

Obsid Pro takes intellectual property rights seriously. This policy describes how we handle reports of alleged copyright infringement in connection with our website and software, and how rights holders may submit notices to us. It also describes the rights of individuals who believe that content has been removed from our systems in error.

This policy is informed by the notice and takedown procedures set out in the Digital Millennium Copyright Act and by equivalent provisions in applicable international copyright law. We will respond to all valid notices promptly and in accordance with this policy.

2. Reporting Alleged Infringement

If you believe that any content made available through Obsid Pro, including any materials appearing on our website or distributed through our services, infringes a copyright you own or control, you may submit a written notice to us. To be valid and actionable, your notice must include all of the following elements.

Your notice must include a physical or electronic signature of the person authorised to act on behalf of the copyright owner. It must clearly identify the copyrighted work or works you claim have been infringed. If multiple works are covered by a single notice, a representative list is acceptable provided it is sufficiently specific.

Your notice must identify the material on our platform or in our software that you claim is infringing, with sufficient detail for us to locate and evaluate it. This may include a URL, a description of the specific location, or the name and version of a software component.

Your notice must include your name, postal address, telephone number, and email address so that we can correspond with you about your claim. It must include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, the copyright owner's agent, or applicable law.

Your notice must include a statement made under penalty of perjury that the information provided is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner. Notices that are materially incomplete or that contain false information will not be acted upon and may expose the submitter to legal liability.

3. Where to Send Notices

All copyright notices, takedown requests, and related correspondence must be submitted to our designated contact by email. Please include the phrase DMCA Notice in the subject line of your message so that it is correctly identified and prioritised.

We aim to acknowledge all valid notices within two business days and to take appropriate action within ten business days of receipt. The time required to investigate and act on a notice may vary depending on the complexity of the claim.

4. Our Response to Valid Notices

Upon receipt of a notice that we determine to be valid and complete, we will take prompt action to remove or disable access to the material identified as infringing. We will also notify the person responsible for the allegedly infringing material, where we are able to do so, that a takedown notice has been received and that the material has been removed.

We will retain a copy of all notices received for our records. We reserve the right to share the content of a notice with the person whose material was removed, to the extent permitted by law, so that they may understand the basis for the removal and decide whether to submit a counter-notice.

In cases where we determine that a notice is invalid, incomplete, or submitted in bad faith, we reserve the right to decline to act on it and to notify the submitter of our determination.

5. Counter-Notices

If you believe that material you are responsible for was removed or disabled as a result of a copyright notice that was submitted in error or that misidentified your material, you may submit a counter-notice to us. A counter-notice is a formal statement disputing the original takedown notice.

To be valid, a counter-notice must include your physical or electronic signature, identification of the material that was removed and the location where it appeared before it was removed, and a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your counter-notice must also include your name, postal address, telephone number, and email address, and a statement that you consent to the jurisdiction of competent courts for the purposes of any action arising from this matter. Upon receipt of a valid counter-notice, we will notify the original complainant that we have received it. If the original complainant does not notify us within ten business days that they have initiated a legal action seeking a court order to restrain the allegedly infringing activity, we may restore the removed material at our discretion.

6. Repeat Infringement

Obsid Pro maintains a policy of terminating, in appropriate circumstances, the accounts of users who are found to be repeat infringers of intellectual property rights. A repeat infringer is a user against whom we have received multiple valid copyright notices or who has otherwise demonstrated a pattern of infringing behaviour.

We apply this policy in a manner that we consider reasonable and proportionate. A single valid notice does not automatically result in account termination, but we reserve the right to suspend or permanently terminate any account where ongoing infringement is evident or where the user has failed to remedy an infringement following notification.

7. Abuse of this Process

Submitting a copyright notice that you know to be materially false constitutes perjury and may expose you to civil and criminal liability. We take abuse of the notice and takedown process seriously. If we determine that a notice was submitted in bad faith, to harass a user, or to suppress legitimate content, we reserve the right to disregard the notice, restore any removed content, and take legal action to recover damages caused by the abuse.

8. Reporting Piracy of Obsid Pro

Obsid Pro software is our proprietary intellectual property. Unauthorised distribution of the Obsid Pro application, cracked or modified versions of the software, or circumvention tools designed to bypass our license validation system constitutes copyright infringement and a violation of applicable law.
